Please read these Terms of Service carefully before purchasing from or using the Kulshan Studios website (kulshanstudios.com). By accessing our website or completing a purchase, you agree to be bound by these terms. If you do not agree, please do not use our site or purchase our products.
1. About Kulshan Studios
Kulshan Studios is a digital music products business based in Washington State, United States, selling synthesizer preset soundbanks and related digital audio content to customers worldwide. References to “we,” “us,” or “our” mean Kulshan Studios. References to “you” or “the Licensee” mean the individual purchasing or using our products.
2. Products and Intellectual Property
All sound files, preset data, and associated content sold by Kulshan Studios are the exclusive intellectual property of Kulshan Studios. Our products are licensed to you, not sold. Purchasing a product grants you a personal, non-exclusive, non-transferable license to use that content under the terms described in Section 3. All rights not expressly granted to you are reserved by Kulshan Studios.
3. License Agreement
By purchasing any Kulshan Studios product — whether through our website or through any authorised third-party retailer — you expressly agree to and accept the following license terms.
3.1 What You May Do
You are licensed to use Kulshan Studios sound files within your original music compositions for both commercial and non-commercial purposes, including:
• Making demos, songs, albums, and records
• Remixes and commissioned pieces
• Commercials and jingles
• Post-production and soundtracks for film, theatre, and musicals
• Production music libraries
• Live performances
3.2 What You May Not Do
The following are strictly prohibited:
• Copying, duplicating, reselling, lending, renting, hiring, or redistributing Kulshan Studios sound files in any form
• Uploading or downloading sound files to or from any database, server, file sharing service, news group, or similar platform
• Transferring your license to any other person or entity
• Purchasing Kulshan Studios products second-hand and using them in compositions or productions
• Using sound files in isolation — such as in video game soundtracks, gaming machines, or toys where they appear as standalone sound effects — without first obtaining a separate written license from Kulshan Studios (subject to availability)
• Using sound files, individually or in combination, to create alternative or competing sample packs or sound libraries
3.3 Single User License
Your license is granted to a single user only and is non-transferable. You may not share, sublicense, or otherwise make your licensed content available to any third party. Completion of a purchase constitutes full acceptance of this license agreement. Any infringement of these terms will be pursued to the fullest extent of applicable international law.
4. Pricing and Payment
All prices are displayed in US Dollars (USD) unless otherwise stated. Kulshan Studios reserves the right to change prices at any time. The price applicable to your order is the price displayed at the time of checkout.
Payments are processed securely by Stripe and PayPal. Kulshan Studios does not store your payment card details. By completing a purchase, you also agree to the applicable terms of your chosen payment provider.
You are responsible for any taxes, duties, or charges applicable in your jurisdiction. Kulshan Studios does not collect VAT or sales tax on behalf of any jurisdiction unless legally required to do so.
5. Digital Downloads and Delivery
All Kulshan Studios products are delivered as digital downloads. Upon successful payment, you will receive access to your purchased files. It is your responsibility to ensure your device and software are compatible with our file formats before purchasing.
In the event of a technical delivery failure, please contact us at kulshanstudios@gmail.com and we will make reasonable efforts to resolve the issue promptly.
6. Right of Withdrawal — EU and UK Customers
If you are a consumer located in the European Union or United Kingdom, you ordinarily have the right to withdraw from a distance contract within 14 days of purchase without giving any reason.
However, under Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) and equivalent UK regulations, the right of withdrawal does not apply to the supply of digital content that is not supplied on a tangible medium, where:
• Performance has begun with your prior express consent, and
• You have acknowledged that you thereby lose your right of withdrawal
Because Kulshan Studios products are digital files delivered by immediate download, and because you will be asked to give your express consent and acknowledgement at the point of checkout before download begins, the right of withdrawal will not apply once your download has commenced.
If you wish to withdraw from a purchase before your download has begun, you may do so by using the withdrawal function on our website or by contacting us at kulshanstudios@gmail.com. We will acknowledge your withdrawal request promptly in writing.
7. Refund Policy
Due to the digital and immediately downloadable nature of our products, we are generally unable to offer refunds once a download has commenced, except where required by applicable law.
If you experience a genuine technical issue that prevents you from accessing your purchased files, please contact us and we will work with you to resolve it. We handle all refund requests on a case-by-case basis and aim to be fair and reasonable.
Nothing in this section affects your statutory rights under the laws of your jurisdiction.
8. Disclaimer of Warranties
Kulshan Studios sound files are licensed “as is” without warranties of any kind, express or implied. We do not warrant that our products will meet your specific creative requirements or fit any particular purpose. You assume full responsibility for your use of our products.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Kulshan Studios shall not be liable for any direct, indirect, incidental, consequential, or special loss or damage arising from:
• Your use of, or inability to use, any Kulshan Studios product
• Any failure of our products to meet your expectations or requirements
• Any copyright, trademark, or other intellectual property infringement claims arising from your use of our sound files within your own musical compositions and productions
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
10. Website Use
You agree to use the Kulshan Studios website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site. You must not attempt to gain unauthorised access to any part of our website or its underlying systems.
We reserve the right to suspend or restrict access to our website at any time without notice.
11. Third-Party Links
Our website may contain links to third-party websites. These links are provided for your convenience only. Kulshan Studios has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.
12. Privacy

For customers located in the European Union or United Kingdom, nothing in this clause affects your right to rely on any mandatory consumer protection provisions that apply in your country of residence.
Any disputes arising under these terms that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Washington State, except where mandatory applicable law provides otherwise.
15. Severability
If any provision of these Terms of Service is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy and the license agreement included with each product, constitute the entire agreement between you and Kulshan Studios with respect to your use of our website and products. They supersede all prior agreements, representations, and understandings.
